Choose the Right Path for Your Situation

Every case is different, so we offer more than one way to resolve yours.

Option What We Do Best If
Confidential settlement We negotiate using your IP address and keep your name off the public court record. You provide your financial information to the plaintiff’s attorneys under a strict confidentiality agreement as part of the settlement. You want to settle quickly while keeping your name out of public records.
Totally anonymous settlement We negotiate without giving the plaintiff your name or financial information. The public never sees either. You want to keep your identity and finances private from the movie company.
Motion to quash We file a federal motion asking the court to stop your ISP from releasing your name. You have strong legal grounds to challenge the subpoena.
Full defense litigation We defend you through discovery and trial if the case goes that far. You did not infringe on the copyright and have evidence to prove it.

Experience Matters When You Receive a Copyright Subpoena

You do not have to figure out your case from scratch. Our attorneys know what to expect when a plaintiff moves forward.

More Than 5,000 Clients

Since 2010, we have represented more than 5,000 clients in copyright cases involving 50+ plaintiffs. That experience helps us approach cases like yours and know what to do next.

Federal Court Experience

Jeff Antonelli started practicing law in 2000 and has litigated in federal court since 2006. He knows what can happen after a plaintiff’s attorney enters the picture and how these cases can move once the court gets involved.

Experience with the Same Plaintiffs

We do not hand your case to whoever happens to be available. You work with an attorney who has handled cases involving the same plaintiff before. That gives you someone who already understands the issues that are relevant to you.

What You Get With Antonelli Law

The difference comes down to how we handle your case from the start.

What Matters to You Antonelli Law Other Attorneys
Keeping your name private We use your IP address as the identifier during settlement talks, so your name stays off the public record in virtually every case. Some attorneys may use your legal name during negotiations from the start.
Knowing your total cost upfront We charge a flat fee, so you know the cost before you hire us. Hourly billing can leave the final cost uncertain as the case takes more time.
Knowing what to do next We review the facts of your case before we recommend whether to settle or challenge the subpoena. An attorney who handles fewer BitTorrent cases may have less experience with these options.

Frequently Asked Questions

What does hiring Antonelli Law cost?

We handle most cases for a flat fee of $3,000. That covers your case from the first consultation through resolution. The fee does not include any settlement payment. We negotiate that amount separately based on your case.

What happens if I ignore the subpoena instead of hiring an attorney?

Ignoring the subpoena does not mean the case will go away, and your ISP can still release your information. The plaintiff can then dismiss the case or file an amended complaint and serve you at home. If you receive the complaint and do not respond, the court can enter a default judgment that becomes part of the public record.

How much could I actually owe if this goes to trial?

Federal copyright law allows the court to award $750 to $30,000 per work. The court can award up to $150,000 per work when it finds willful infringement. That amount sets the maximum. It does not represent the typical outcome.

Can you represent me if I live outside Illinois?

Yes. These cases go through federal court, so we can represent you no matter where you live. We file electronically across the country and have represented clients in more than 20 states. We handle the most cases in California and New York.

What if the person who downloaded the content is a minor in my household?

We can often resolve a case without any payment to the movie company when a minor downloaded the content. Jeff has reached that outcome in about 9 out of 10 cases involving minors. Each case depends on its own facts.
