Bodyguard Productions, Inc. has filed federal copyright infringement lawsuits alleging illegal downloads of the movie "The Hitman's Bodyguard."

Your first notice of the lawsuit will probably be a letter from your internet service provider (ISP) like Comcast, Cox, Time-Warner, Verizon or AT&T, and a subpoena from Bodyguard Productions, Inc.

Bodyguard Productions, Inc. accuses defendants of copyright infringement by using software such as BitTorrent and the internet to obtain the film titles “The Hitman’s Bodyguard” without paying the appropriate license fee.

The Bodyguard Productions, Inc. lawsuit is one of many “free movie” download cases we see, which are sometimes called “copyright troll” lawsuits or BitTorrent lawsuits. BitTorrent is a common software people use to illegally obtain movies online.

Critics of these lawsuits say it’s about the movie company generating more revenue. The movie company says it is filing these lawsuits to stop piracy of its intellectual property.

What is this about?

What to do about your Bodyguard Productions, Inc. subpoena.

Why have I received this?

The ISP letter and Bodyguard Productions, Inc. subpoena probably relate to a federal copyright infringement lawsuit alleging that someone in the home or office illegally downloaded “The Hitman’s Bodyguard” using file-sharing software such as BitTorrent.

Is it real?

Yes. If you have received a notice from your internet provider with a copy of a subpoena, you are being sued. Ignoring the subpoena will reduce your options to fight it.

Typically, you only have two weeks to a month to file a motion to quash or vacate the subpoena.

Once you’ve received a subpoena, there are three options available:

  • Resolve anonymously
  • File a motion to quash before it gets to court
  • Prepare to fight it in court. We are experienced litigators who fight back vigorously

In some cases, people who receive the notice from their internet service provider and a copy of the subpoena requesting their details will not be served with a summons. Instead, once the attorneys representing Bodyguard Productions, Inc. receive the defendants name and address, they will send out a letter directly explaining the copyright infringement lawsuit they filed on behalf of movie company, and offer the ISP Subscriber the opportunity to settle for a certain dollar amount if the settlement is received within a specific timeframe (typically around 10 days), after which the settlement amount will increase.

If the movie company is not contacted by the ISP Subscriber or their lawyer after some period of time, a second letter is then sent to the ISP Subscriber.

In that second letter, the movie company offers the ISP Subscriber a higher settlement amount to resolve the copyright infringement claim out of court, and further states that if the matter is not settled soon, the movie company may proceed with litigation against the ISP Subscriber named in the letter.

We’ve helped thousands of clients across the US resolve their cases and can help you figure out the best course of action for you.

Why have I received a Waiver of Service Summons form?

Don’t sign a Waiver of Service of Summons form before speaking with an attorney.

As defense attorneys, we are concerned that people receiving a Waiver of Service of Summons form in the mail from the movie company’s lawyer will lead to an unfair default judgment against them. Please speak with an attorney experienced in movie download federal copyright lawsuits.

The prevalence of this happening varies over time, state, and the legal counsel representing the movie company.

There are two scenarios that tend to happen with Waiver of Service Summons forms:

Scenario 1: You have received the form but do not yet have a lawyer representing you.

In this scenario, you probably received a notice from your internet service provider and a copy of the subpoena from Bodyguard Productions, Inc. but ignored it. As a result, Bodyguard Productions’ lawyers were able to use the court to get your name and address, and they have now sent you the form by mail.

It’s not too late to get legal representation! Make sure you have a consultation to understand your options for moving forward.

Scenario 2:

You have legal representation who has contacted Bodyguard Productions, Inc. on your behalf to negotiate settlement options.

These settlement negotiations have not yet been successful by the time the court’s deadline to serve the defendant comes around, so the movie company HAS to serve the defendant with the lawsuit Summons or else their lawsuit will be dismissed by the Court.

So, the movie company attorney requests that the lawyer representing the ISP Subscriber (Defendant) accept service of process on behalf of the defendant so the movie company attorney does not have to hire a process server or US Marshalls to physically find the defendant and hand them the court lawsuit Summons.

In this second scenario, it can be highly advantageous for the defense attorney to accept service of the summons on behalf of the client (with the client’s consent) due to a technicality that allows the Defendant much more additional time for negotiations until paperwork must be filed in court.

We use this additional time (a total of 60 days) to continue settlement negotiations without further cost to the client.

Much of the time the case will settle before more expensive paperwork must be drafted and then filed in the court before the 60 day period runs out.

How much will it cost?

Hiring Antonelli Law Is No More Expensive than Hiring a Local Attorney in Your State

Antonelli Law’s numerous federal court admissions, local counsel affiliations, and the nature of federal lawsuits allow us to effectively and cost-consciously represent you in your copyright infringement defense, no matter which state you live in – and no more expensively than a local attorney.

We are able to represent you in your federal case without being more expensive or more difficult to hire than hiring a local attorney because federal courts require attorneys to file their papers electronically, and often conduct hearings by telephone. This makes frequent trips to the courthouse unnecessary. Also, we do not charge for airline flights or flying travel charges. Clients pay only for the normal travel time to the courthouse any local attorney would charge.

Finally, we have affiliated local counsel in many states who have earned our trust and can appear in court on an expedited basis when necessary. We will of course be in court personally when necessary such as non-routine hearings or a trial.

We offer a reasonable Flat Fee for motions to quash, and helping you settle and remain anonymous in many cases; and reasonable fees for defending you if you are named as a defendant in a copyright infringement lawsuit such as the LHF Productions lawsuit.

What can I expect from Antonelli Law?

This is what clients say Antonelli Law is very good at:

  • Reducing your anxiety about the problem
  • Giving clear information to help you decide what to do
  • Responsive and accessible via phone and email
  • Tenacious and effective representation in lawsuit litigation
